ORDINANCE NO. 03-58

AN ORDINANCE REPEALING CHAPTER 27, POOL AND BILLIARD HALLS
AND REPLACING IT WITH CHAPTER 27, ENTITLED "BICYCLES"
OF THE VILLAGE OF WINSLOW ORDINANCES

NOW THEREFORE, BE IT ORDAINED by the President and the Board of Trustees of the
Village of Winslow, Illinois, as follows:

That the following Chapter 27, entitled "Bicycles" shall be added to the Winslow Municipal
Code and it shall read as follows:

CHAPTER 27 BICYCLES

Section 27-1.   APPLICATION OF CHAPTER

    The provisions of this chapter shall apply whenever a bicycle is operated upon any
    public way including but not limited to streets or sidewalks.

Section 27-2.   REGISTRATION OF BICYCLES

  (a)  The Village Marshall, or an appointee so designated, shall be the person to
    whom all applications for registration are to be made.

  (b)  A registration fee of one dollar ($1.00) shall be paid upon application.

  (c)  The Village Marshall, or an appointee so designated, is authorized to issue a
    a bicycle license, which shall be effective until the next succeeding May 1 of
    even-numbered years.

  (d)  No bicycle shall be registered when he or she knows, or has reasonable
    grounds to believe, that the applicant is not the owner thereof.

  (e)  No bicycle shall be registered unless it is in good mechanical condition and
    equipped with an adequate braking device.

  (f)  A record shall be kept of each registration, the date issued, the
    name and address of the person to whom issued, the number of the frame of
    the bicycle for which issued and all bicycle registration fees collected by the
    Village.

  (g)  It shall be unlawful for any reason to remove, deface, change or cause to be
    removed, obliterated, defaced or changed, any factory serial number or mark
    on or from any bicycle.

  (h)  Upon the transfer of a registered bicycle, the registration shall remain on such
    bicycle and shall be assigned to the transferee upon proper application.

Section 27-3.   PARENTAL RESPONSIBILITY

    The parents of a child under sixteen years of age and the guardian of a ward under
    sixteen, shall not permit any such child or ward to violate any of the provisions of
    this chapter.

Section 27-4.   SPEED

    No person shall operate a bicycle at a speed greater than is reasonable and prudent
    and every bicycle shall be operated with reasonable regard for the safety of the rider
    and of other persons and property.

Section 27-5.   RACING

    It is unlawful for any person to run, or engage, or cause to be engaged in, any bicycle
    race on any street, alley, or public place with the Village limits except under permit
    issued by the Village.

Section 27-6.   RIDING ON SIDEWALKS

    Whenever a person is riding a bicycle upon a sidewalk, such person shall yield the
    right of way to any pedestrians.

Section 27-7.   PARKING

    No person shall park any bicycle on any sidewalk which would impede the flow of
    pedestrian traffic.

Section 27-8.   LIGHTS

    Every bicycle when in use at nighttime shall be equipped with a lamp on the front
    which shall emit a white light visible from a distance of at least five hundred feet to
    the front and with a red reflector on the rear which shal be visible from 100 to 600 feet.

Section 27-9.   HELMETS

    No person under 16 years of age shall operate a bicycle, or ride as a passenger on a
    bicycle or a bicycle trailer, on a public roadway, sidewalk, or other public-way unless
    wearing a protective helmet designed for public-safety which meets or exceeds the
    standards set by the American Standards Institute (ANSI), the American Society for
    Testing and Materials (ASTM) or the Snell Foundation.

Section 27-10.   SUDDEN MOVEMENT INTO TRAFFIC

    No bicyclist shall ride in the path of a vehicle which is so close that it is difficult for
    the operator of the vehicle to yield.

Section 27-11.   IMPOUNDMENT OR FINE

    Any person regardless of age, who violates any provisions of this chapter, or of any
    provision of the Illinois Vehicle Code relating to bicycles, shall be punished by a fine
    and/or by having his or her bicycle impounded for a period not to exceed thirty days.
    An impoundment fee of Twenty Dollars ($20.00) will be charged before property can
    be returned. The first impoundment will last for a period of five days. A second
    impoundment will be for a period of ten days. A third impoundment will last for a
    period of thirty days

Section 27-12.   PENALTY

    Whoever violates any of the provisions of this ordinance shall be fined not less than
    Twenty-Five Dollars ($25.00) nor more than Two Hundred Dollars ($200.00) for
    each violation.
